ABC News: Comey says his belief Clinton would win election 'a factor' in email probe
Former FBI director James Comey says his belief that Hillary Clinton would win the 2016 presidential election played a role in the way he handled the investigation into her use of a private email sever as secretary of state.
The former FBI director, who was abruptly fired by Trump last year, announced in July 2016 that he would not recommend charges in the investigation of Clinton's email practices. But in a controversial move, Comey told Congress just days before the election that the FBI was reviewing additional emails in relation to the investigation. In early November, Comey then informed lawmakers that those emails did not warrant any further action. Ref. CNN.
So then Hillary's assessment of the election was correct. Comey felt Hillary would win and started the Email probe that may have changed things. Its amazing that he would come forward to state that.

In this situation, can Hillary sue Comey based on American law over this reasoning or was Comey in his right to open an investigation?

He was within his rights to open an investigation. He was especially within his rights to attempt to vet a presidential candidate that may be (Very much is in my opinion) questionable before she could take office.
The only question is whether or not he had an alternative means to handle it. It doesn't sound like he did.
Thank you for the clarification. Then Comey would of had to do the same with Trump given his questionable dealings with the Russians before the election, yet it seems that Comey did not give as much public suspicion over Trump as he did with Hillary. Maybe he regrets that now.

A USA TODAY review of all 3,500 ads bought by Russian operatives on Facebook found that hundreds of them related to immigration or targeted Hispanics. They were shown millions of times. One set targeted users with pro-immigration messages, while another set zeroed in on users whose views aligned with President Trump on immigration and deportation. The aim? That's not going to change, people will still fall for pervasive ads and controversial issues and will do the same come next election.
