Texas Man Charged When Girlfriend Asks Him to Kill Her Unborn Twins

Austin, TX (LifeNews.com) -- Authorities in Texas now say an 18-year-old man beat his pregnant girlfriend in order to kill a set of twins neither of them wanted. Last May, 16-year-old Erica Basoria lost her unborn sons after she asked her boyfriend, Gerardo "Jerry" Flores, to step on her stomach. "When I was four months pregnant, I began to show, and at that time I decided that I should have gotten an abortion," Basoria said in an affidavit. Basoria cannot be prosecuted because, under Texas law, mothers have a right to end their pregnancies. However, the children's father has been charged with murder under a state law protecting unborn children against attack. Basoria has told authorities she had been trying to kill her unborn children for weeks before Flores attacked them. Ryan Deaton, the defense attorney, asked in conversations with reporters, "How can two people conspire to do something like this and only one of them be punished? How can that be fair?" Angelina County District Attorney Clyde Herrington echoed Deaton's view. Herrington told the media "It doesn't seem entirely fair. It is somewhat startling to me that they completely leave the female out of the criminal penalty"¦I would suspect that in a case of this nature, if the jury or the judge figures that out, then it could have an impact on the punishment. They might go light on him."

Twins Unborn Kill Conspire Two

I feel completely sick to my stomach after reading that. It is outright pathetic for people to go that far, or even close to it. I'm against abortion from the start, but outright murdering children in such a manner? And only one gets arrested for it? Texas law seriously to think about what sort of a position it just put these two people in.

It also makes me wonder what in the world would posess two people to do something like that. The word evil is in my mind right now. Those people are outright evil to murder to babies. Not to sound like some religious radical, but they seriously need a touch of God in their lives. They didn't create adoption for no reason. She could have gone the rest of the term, and put the babies up for adoption so that they could have a chance at a decent life.

I hope both of them get thrown in jail. They deserve it, as harsh as that may sound. I hope they spend the rest of their lives feeling sorry for what they've done.

While I am against abortion, I don't see what they did as any different than abortion. They killed these two children, but they were not born yet. That is exactly what abortion does. I don't think either of them should be charged with a crime. She can't be because she has the legal right to end the pregnancy. Seems to me if she has that right and asked her boyfriend to do this, then he isn't any more culpable than a doctor who would have performed an abortion.

So, while I think it is a terrible thing, I don't see the crime under current US law.

I agree completely with Tena. How can the man be charged with murder. I can only see that he can be charged with practicing medicine without a license. After all, he only did what countless doctors do every day.

Tena, that certainly is an interesting way to look at it and I may use it elsewhere when someone thinks abortion is 'OK', however, two things come into mind; (1) The man performing the act is not a doctor nor were the methods medical and as a result the mother could be hurt / damaged for life and the babies could also likewise still be alive thus prolonging the inevitable suffering that comes from it. (2) It is obvious that this act was based on devious intentions from the start else why would it be performed like this in the first place. It makes it very different from making an appointment and going through the 'licensed' method of abortion. The world has come to naught and I am sure that there are occurences of this type of behavior more often than we think.

As Nighthawk said, maybe charge him with performing a medical procedure without a license, but of course, beating his girlfriend can hardly be called a medical procedure. You could also charge him with assault against the girlfriend, but I think she would need to cooperate for that to work.

I wonder what the pro-choice crowd will say about this issue. They were rather silent, if memory serves me, when Scott Peterson was charged with killing his unborn son. There were concerns then that allowing him to be charged with murder might help erode abortion rights, but they couldn't object very loudly because what he did was so terrible. This time, though, the woman who was pregnant wanted the pregnancy terminated. They probably didn't have the money to pay for an abortion, otherwise, why wouldn't they just go get one the conventional way?

I don't think it was a money issue because in the article it says that she said something about not realizing until she was four months pregnant that she should have gotten an abortion. If it were a money issue, I don't think she would have had that kind of thinking.

I look at abortion as murder. To me, it is outright child murder. In my world, people who committed such an act would be arrested. Of course, I'm not going to go blow up abortion clinics or anything because that is NOT a positive way of dealing with it.

It just urks me that this girl is not allowed to vote because of her age, yet she can murder two babies and no consequences come to her. That really angers me that people can get away with such a disgusting and pathetic act as that. She told her boyfriend to stand on her stomach.

I agree with you Ambria. I consider abortion murder, as well. I am just saying that as long as abortion is legal, I can't see how this isn't also legal. I think if we are going to allow unborn children to be killed how can we say you can kill them this way, but not this way. Let's call it all what it is...murder, whether abortion or not. In my opinion anyway.

For someone who doesn't consider abortion murder, then how can they consider this murder. That is what I guess I am wondering/questioning.
