From what I heard on the news, Kushner is being talked to as a witness. He is not actually under investigation himself. I note that these articles tend to either leave that out or bury it deep in the article… and the headlines are so misleading. They almost gleefully misrepresent the news so they can hobble this administration. They are not doing right by the country. They need to report, not editorialize.

The opinion would be damning except for one huge difference between Mr. Kushner and Ms Clinton. Her server was proven and is an established fact. The whole case against him is circumstantial based on some anonymous letter at the WaPo that they refuse to reveal. Furthermore, there are sources that dispute the letter who claim to have been in the room. They claim this was something the Russians offered, not President's Trump's team sought. Big difference there.
