In this case "Threatening" refers to bringing it up but not executing anything as yet. We already got an answer from Lucas on this an it was "No". I've seen recent talk that they are actively looking for sites using their images as well and asking them to take it down. When you have the kind of success they're having they don't need 'small' sites using their stuff for free.
